Management of personal data

The Client is informed of the regulations concerning marketing communications, the French Act of 21 June 2004 on confidence in the digital economy (loi pour la confiance dans l’économie numérique), the French Data Protection Act (loi Informatique et Libertés) of 6 August 2004 and the General Data Protection Regulation (GDPR: No. 2016-679).

Parties responsible for the collection of personal data

For Personal Data collected in connection with the creation of the User’s personal account and the User’s browsing on the Site, the controller of the Personal Data is: MIDI MAS. midi-mas.fr is represented by Renato and Giani Scherer, its legal representatives. As the controller of the data it collects, midi-mas.fr undertakes to comply with the applicable legal provisions. It is in particular incumbent upon the Client to establish the purposes of its data processing, to provide its prospects and clients, upon collecting their consent, with complete information on the processing of their personal data, and to maintain a record of processing activities that reflects actual practice. Whenever midi-mas.fr processes Personal Data, midi-mas.fr takes all reasonable measures to ensure that the Personal Data are accurate and relevant with regard to the purposes for which midi-mas.fr processes them.

Purpose of the data collected

midi-mas.fr may process all or part of the data:

midi-mas.fr does not commercialise your personal data, which are therefore used only where necessary or for statistical and analytical purposes.

Enquiries sent via our contact form

Our enquiry form collects your first name and surname, your telephone number, the status of your plot (purchased, purchase agreement signed or still searching), the municipality of the plot or the area under consideration, your intended budget, your desired timeframe and your email address. This information is used solely to assess your enquiry and to arrange an initial discussion, at your initiative. Your name and telephone number are recorded as soon as you tick the consent box, even if you do not complete the form. Unless you refuse “Advertising” in the cookie banner, the ad keyword and the ad click identifier (GCLID, GBRAID or WBRAID) are associated with your enquiry; if our team qualifies it, our CRM sends this qualification to Google Ads with that click identifier, without your contact details. Unless you refuse “Audience measurement”, our CRM associates with your enquiry the device, the browser, the IP address, the pages viewed on this site (bespoke villa pages, form and legal pages) and how long they were visible, measured from your arrival. URL parameters and pages on other sites are not recorded as part of this journey. The IP address and the journey are not sent to Google by this connector. You can object at any time via “Cookie settings” at the bottom of the page. A refusal expressed in the same browser tab as your enquiry, no later than 24 hours after your last entry, is passed on to it: a refusal of “Audience measurement” erases the journey from it; a refusal of “Advertising” erases the click identifiers from it, and the qualification is then never sent to Google Ads if it has not already been sent. In other cases, write to us (see “Right of access, rectification and objection” below). Your project can still be assessed if you refuse. The assessment of the enquiry you send is based on steps taken at your request prior to entering into a contract (Article 6(1)(b) GDPR). If the budget stated does not allow a Midi Mas villa to be built, the form tells you so immediately and your enquiry is recorded as unqualified; our team may review this classification. The form is protected against automated submissions by Google reCAPTCHA. If you choose to write to us on WhatsApp, your message passes through that service, which is subject to its own terms. Your information is neither transferred nor resold. It is kept for three years from our last exchange, unless you ask us to delete it sooner.

Right of access, rectification and objection

In accordance with the applicable European regulations, Users of midi-mas.fr have the following rights:

As soon as midi-mas.fr becomes aware of the death of a User, and in the absence of instructions from that User, midi-mas.fr undertakes to destroy their data, unless their retention proves necessary for evidential purposes or to comply with a legal obligation. If the User wishes to know how midi-mas.fr uses their Personal Data, to request their rectification or to object to their processing, the User may contact midi-mas.fr in writing at the following address: MIDI MAS – 1190, Chemin de Saint-Bernard 06220 Vallauris. In this case, the User must indicate the Personal Data that they would like midi-mas.fr to correct, update or delete, identifying themselves precisely with a copy of an identity document (identity card or passport). Requests for the deletion of Personal Data will be subject to the obligations imposed on midi-mas.fr by law, in particular with regard to the retention or archiving of documents. Finally, Users of midi-mas.fr may lodge a complaint with the supervisory authorities, in particular the CNIL, the French data protection authority (https://www.cnil.fr/fr/plaintes).

Non-disclosure of personal data

midi-mas.fr undertakes not to process, host or transfer the Information collected about its Clients to a country located outside the European Union or recognised as “not adequate” by the European Commission without first informing the client. Nevertheless, midi-mas.fr remains free to choose its technical and commercial processors, provided that they offer sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: No. 2016-679). midi-mas.fr undertakes to take all necessary precautions to preserve the security of the Information and, in particular, to ensure that it is not disclosed to unauthorised persons. However, if an incident affecting the integrity or confidentiality of the Client’s Information is brought to the attention of midi-mas.fr, it must inform the Client as promptly as possible and notify the Client of the corrective measures taken. Furthermore, midi-mas.fr does not collect any “sensitive data”. The User’s Personal Data may be processed by subsidiaries of midi-mas.fr and by processors (service providers), exclusively in order to achieve the purposes of this policy. Within the limits of their respective duties and for the purposes set out above, the main persons likely to have access to the data of Users of midi-mas.fr are principally the agents of our customer service department.

Incident notification

Whatever the efforts made, no method of transmission over the Internet and no method of electronic storage is completely secure. We therefore cannot guarantee absolute security. Should we become aware of a security breach, we would notify the users concerned so that they could take appropriate measures. Our incident notification procedures take account of our legal obligations, whether at national or European level. We undertake to keep our clients fully informed of all matters relating to the security of their account and to provide them with all the information necessary to help them meet their own regulatory reporting obligations. No personal information of the user of the midi-mas.fr site is published without the user’s knowledge, exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only in the event of the acquisition of midi-mas.fr and its rights could the said information be transmitted to any such acquirer, who would in turn be bound by the same obligation to retain and modify the data with respect to the user of the midi-mas.fr site.

Security

To ensure the security and confidentiality of Personal Data and Personal Health Data, midi-mas.fr uses networks protected by standard mechanisms such as firewalls, pseudonymisation, encryption and passwords. When processing Personal Data, midi-mas.fr takes all reasonable measures to protect them against any loss, misuse, unauthorised access, disclosure, alteration or destruction.

Hyperlinks, cookies and web beacons (“tags”)

The midi-mas.fr site contains a number of hyperlinks to other sites, set up with the authorisation of midi-mas.fr. However, midi-mas.fr is unable to check the content of the sites thus visited and will accordingly accept no liability in this respect. The audience measurement and advertising cookies described below are set as soon as you arrive on the site; the banner displayed on your first visit lets you refuse them. You may object to them at any time, free of charge, using the deactivation options offered to you and set out below. Refusing these cookies has no effect on your use of our pages.

Cookies

A “cookie” is a small information file sent to the User’s browser and stored on the User’s device (e.g. computer, smartphone) (hereinafter “Cookies”). This file contains information such as the User’s domain name, the User’s Internet service provider, the User’s operating system, and the date and time of access. Cookies cannot under any circumstances damage the User’s device. midi-mas.fr may process information concerning the User’s visit to the Site, such as the pages viewed and the searches carried out. This information enables midi-mas.fr to improve the content of the Site and the User’s browsing. As Cookies facilitate browsing and/or the provision of the services offered by the Site, the User may configure their browser to allow them to decide whether or not to accept them, so that Cookies are either stored on the device or, on the contrary, rejected, either systematically or according to their issuer. The User may also configure their browser software so that the acceptance or refusal of Cookies is offered to them on a case-by-case basis, before a Cookie may be stored on their device. midi-mas.fr informs the User that, in this case, not all the functions of their browser software may be available. If the User refuses the storage of Cookies on their device or browser, or if the User deletes those stored there, the User is informed that their browsing and experience on the Site may be limited. This could also be the case where midi-mas.fr or one of its service providers cannot recognise, for technical compatibility purposes, the type of browser used by the device, the language and display settings or the country from which the device appears to be connected to the Internet. Where applicable, midi-mas.fr declines all liability for the consequences relating to the impaired functioning of the Site and of any services offered by midi-mas.fr resulting from (i) the User’s refusal of Cookies (ii) the impossibility for midi-mas.fr to store or consult the Cookies necessary for their functioning owing to the User’s choice. For the management of Cookies and of the User’s choices, the configuration of each browser is different. It is described in the browser’s help menu, which will explain how the User can change their preferences with regard to Cookies. At any time, the User may choose to express and change their preferences with regard to Cookies. midi-mas.fr may also use the services of external providers to help it collect and process the information described in this section. Finally, by clicking on the icons dedicated to the social networks Twitter, Facebook, Linkedin and Google Plus appearing on the midi-mas.fr Site or in its mobile application, the User opens the website of these networks, which may then place cookies on the User’s devices (computer, tablet, mobile phone) under their own terms. No social network button places cookies on our pages; the cookie banner therefore has no category for these networks.

Across the whole site (www.midi-mas.fr and our bespoke villa pages), audience measurement and advertising cookies are set as soon as you arrive, before you make any choice. The banner displayed on your first visit lets you refuse them, entirely or category by category:

To object, click “Customise” in the banner, then “Reject all”, or tick only the category you accept and then click “Save my choices” (categories are unticked there by default); you can also do so later, at any time, via “Cookie settings” at the bottom of the page. Your refusal is passed on to these tags, which stop the measurement concerned on the open page and on later visits, and the cookies of the refused category (_ga and _ga_4RSN3Y74EJ, or _gcl_au and _gcl_aw) are erased. A refusal of “Advertising” passed on to your enquiry before its qualification is sent permanently excludes sending it to Google Ads (see Enquiries sent via our contact form).

Your choice is kept for six months; after that, measurement resumes and the banner is shown again. You can change it at any time.

Cookie-free audience measurement and technical errors

To improve our pages, we anonymously count the stages of the visit: page viewed (version, language, device type, whether or not you arrived from an ad), proportion of the page scrolled through, click through to the form, form questions reached, whether you already have a plot, outcome of the form, as well as rejected entries (a field left empty, for example, never what you have written). No cookie is placed, no identifier is created and these statistics are not linked to your enquiry. They are kept for no more than 25 months and are for the exclusive use of Midi Mas.

When a technical error prevents a page or the form from working, its description, the page concerned and the browser type are sent to us so that we can fix it. This report, without any other information about your visit, remains active even if you object to audience measurement.

Your browser’s “Global Privacy Control” and “Do Not Track” signals are respected. You can also ask not to be counted on this browser.

Web beacons (“tags”)

midi-mas.fr may occasionally use web beacons (also known as “tags”, action tags, single-pixel GIFs, clear GIFs, invisible GIFs and one-to-one GIFs) and deploy them through a web analytics partner which may be located (and therefore store the corresponding information, including the User’s IP address) in a foreign country. These beacons are placed both in the online advertisements that enable internet users to access the Site and on the various pages of the Site. This technology enables midi-mas.fr to assess visitors’ responses to the Site and the effectiveness of its actions (for example, the number of times a page is opened and the information viewed), as well as the User’s use of this Site. The external service provider may collect information about visitors to the Site and to other websites through these beacons, compile reports on the Site’s activity for midi-mas.fr, and provide other services relating to the use of the Site and of the Internet.
